Montgomery County Search and Rescue Team
ARTICLE I - PURPOSES
1.01 Definition. The Montgomery County Search & Rescue Team, herein referred to as (MOCSAR), is a 501(c)(3)
non-profit organization dedicated to Searching, Finding, and Rescuing individuals, groups of people, or items that are lost or in
need of aid.
(a) MOCSAR shall be composed of private civilian volunteers in good community standing that are willing to dedicate
their time and personal resources to serve their community.
(b) The purposes of MOCSAR include raising of funds, purchasing personal property to be used by members, and
performing services along with engaging in other charitable, civic, or educational activities that will contribute to the
good of the public, and exercising powers conferred by the laws of Texas for non profit organizations within the
501(c)(3) definition.
(c) No part of the net earnings of the organization shall benefit any Director, Coordinator, Officer, Member or any
private individual, except that reasonable compensation may be paid for goods or services rendered to or for
MOCSAR affecting one or more of its purposes.
(d) No substantial part of the activities of MOCSAR shall be the carrying on of propaganda, or otherwise attempting to
influence legislation, and MOCSAR shall not participate in, or intervene in any political campaigning on behalf of
any candidate for public office.
(e) Notwithstanding any other provision of these Bylaws, MOCSAR shall not conduct or carry on any activities not
permitted to be conducted or carried on by an organization exempt from taxation under Section 501(c)(3) of the
Internal Revenue Code and its regulations as the now exist or as they may hereafter be amended, or by an
organization, contributions to which are deductible under section 170(c)(2) of the Internal Revenue Code and
Regulations, as they now exist or as they hereafter be amended.
(f) MOCSAR is self-governing, self supporting, non-commercial, non-profit, and non-partisan, and shall not seek to
direct the administrative activities of Montgomery County, its Municipalities, or its policies.
1.02 Dissolvement. In the event MOCSAR must dissolve its assets and monetary holdings:
(a) Equipment must be sold at fair market price.
(b) All monetary funds to be distributed to Non-Profit Community Organizations that benefit First Responder Families
such as the Fire Department, E.M.S., etc.
1.03 Deployment. MOCSAR being a non-profit organization may be deployed to locations, where services are required,
by any law enforcement or government aid agency at any time.
(a) In the case of a declared National Emergency, or an Emergency declared by the Texas County Governing Authority
(e.g. County Judge / Director OEM), of this or another county, MOCSAR may deploy to those locations and make
our resources readily available to the authorized command structure that is already operational and in place.
(b) MOCSAR may also be deployed by any City, County or State Government Body including the Montgomery County
Sheriff Department or Constable, as needed, at any time.
(c) MOCSAR may train with other non profit organizations within the United States of America to assist in
certifications, training, or other benefits that may assist the good of the general public.
(d) Self Deployment will not be permitted at any time under any circumstance.
1.04 Authority. MOCSAR has sole authority for its own Business, Fund-Raising, Functions, Meetings, Training
Exercises, Call Out Mission Procedures, Collection and Distribution of Funds, Expenditures, Equipment Use, Buying and
Selling Equipment, Recruiting Members, Maintaining Active Membership, Disciplinary Action Against Members.
(a) All changes to MOCSAR shall be decided upon by a majority vote of the General Membership.
(b) Majority votes that are established by the General Membership shall act as the majority vote of the Board of
Directors.
(c) Any concern that cannot be brought to a majority vote, shall be arbitrated by the President of the Board of Directors.
Arbitration shall not be performed until all reasonable efforts have been made to establish a majority vote.
(d) Changes and additions to the Bylaws or MOCSAR shall not take effect until thirty one (31) days or the day after the
following General Meeting established in Article III, 3.01, pending any member contest that is made.
ARTICLE II - MEMBERS
2.01 Membership. Members who meet the minimum requirements shall be voted in by a majority vote during a general
meeting described in Article III 3.01. Minimum requirements are as follows:
(a) Must attend three meetings within one year to begin membership.
(b) Must attend 3 meetings, callouts, or trainings per year to be considered active in membership.
(c) Must pass a background check.
(d) Must complete an Application Form, Background Check Permission Form, and Liability Waiver Form.
(e) Must complete th e ICS 100 course at fema.gov and submit a copy of the certificate prior to the 3rd meeting.
(f) Must not act or behave in an unprofessional manner, and must maintain good conduct during a callout, or at any
MOCSAR sponsored functions including, but not limited to: General Meetings, Fundraisers, Events, Sponsorship
Meetings.
(g) May not have any previous felony convictions, or misdemeanor convictions of violent, aggravated, or sexually
related crimes.
(h) May not have any open or pending felony charges, or misdemeanor charges of violent or sexually related crimes.
(i) May not abuse recreational, or prescription, drugs, or alcohol in any way.
2.02 Age Requirement. Minimum requirement to be an adult member is 18 years of age. A junior member minimum age
requirement is 14 years of age.
(a) Junior members will not be allowed to vote in the Officer Elections or during general meeting issues.
(b) No one under 16 years of age will be allowed to participate in actual callouts unless he/she is with a parent or legal
guardian.
(c) No one under 14 years of age will be allowed at the Command Center location during an actual call out. This
includes being with a parent or legal guardian.
(d) Parents or legal guardians must be a member of MOCSAR.
2.02 Clothing. Any member wearing MOCSAR identifying gear or clothing, may not engage in illegal or questionable
activity that would bring a harmful or embarrassing image to MOCSAR.
(a) Navy blue jackets and caps, etc. may be worn for public relation reasons as long as they are found to be in good
spirit.
(b) Red shirts or jackets may not be worn in public for any reason except an official callout or event that is approved by
the President.
(c) Jackets, caps or other MOCSAR clothing may not be worn in any place where the main business is serving alcoholic
beverages.
(d) Public fund raisers are an exception to this rule if approved by the MOCSAR officers prior to.
2.03 Impersonation. Anyone posing as a law enforcement officer, or MOCSAR Team Member that was not approved by
the Board of Directors, is subject to municipal, county, state or federal laws and may be removed from MOCSAR.
2.04 Removal. Any violation, by any member, of conduct described in Article II, 2.01, or any other issue, including but not
limited to, violations of Municipal, State, or Federal Law will be subject to disciplinary action from MOCSAR as well as the
punishment appropriate by the applicable penal codes enforced by the law.
(a) Any Member may be removed, with cause, by a majority vote of the Board of Directors.
(b) Removal of a member and disciplinary action shall be established in two separate votes.
(c) All disciplinary actions against a member will be determined by the President, two (2) officers and two (2)
non-officer members. Issue will be decided by a majority vote of these five (5) and will act as a majority vote by the
Board of Directors.
(d) Actions that require law enforcement will be turned over to the appropriate Law Enforcement Agency.
2.05 Compliance. All rules set forth by the MOCSAR organization must be abided by all General Members, Board
Members and Officers. Infractions of the Bylaws or Constitution will bring disciplinary action against the offending member as
described in Article II, 2.04
(a) Any person, including members and officers, may be asked to leave the area of a call out or event as determined by
the Incident Commander, other Officer of MOCSAR, or by a member of law enforcement. Any person refusing to
comply with a removal from a scene will be turned over to a law enforcement officer on scene, and will face
disciplinary action from the Board of Directors.
(b) No member may talk to, or speak for the Organization, to any public media or news agencies, unless previously
approved by the Board of Directors. Any member found violating this rule will be placed on an immediate
probationary period and/or subject to immediate removal from MOCSAR. This will include any form of
communications between members and:
(i) Public News Agencies
(ii) Social Media Platforms
(iii) Non MOCSAR Members
(iv) Law Enforcement Agencies
(c) Any member speaking on behalf of MOCSAR without permission will be subject to disciplinary action and will also
be subject to a probationary period as defined in Article II,2.04 and/or removal from the MOCSAR Organization.
(d) Members may not post photography or video on any social media platform until approved by the President or Vice
President.
(e) Must not act or behave in an unprofessional manner, and must maintain good conduct during all events.
(f) May not have any previous felony convictions, or misdemeanor convictions of violent, aggravated, or sexually
related crimes.
(g) May not have any open or pending cases of felonies, or misdemeanor violent, aggravated, or sexually related crimes.
(h) May not abuse recreational, or prescription, drugs, or alcohol. No alcoholic beverages or illegal drugs will be
permitted at any time during a callout, or at any MOCSAR sponsored functions including, but not limited to: General
Meetings, Fundraisers, Events, Sponsorship Meetings.
(i) Any members found intoxicated, or under the influence, or in possession of drugs, narcotics or alcohol, during
such events, will not be allowed to respond to Callouts, and will be subject to disciplinary actions by MOCSAR,
and/or arrest if circumstances are warranted or determined by the appropriate law enforcement agency.
2.06 Disciplinary Definition. A Disciplinary Action shall be defined as the condition brought against a member of
MOCSAR that is a direct result of a violation of these bylaws, or a failure to maintain appropriate conduct or professionalism.
Disciplinary Actions that are brought against a member of MOCSAR shall include, but will not be limited to:
(a) Ninety (90) Day Probationary Period
(b) Suspension from attending callouts
(c) Temporary suspension from duties
(d) Consideration of removal
2.07 Duty to Report. All members of MOCSAR have a duty to report any new criminal charges, convictions, or
adjudications brought against them to the President or Vice President within thirty (30) days.
ARTICLE III - MEETINGS
3.01 Monthly Meeting. A General Meeting will be held on the last Thursday of each month from January through
November for the general public, with no meeting scheduled in December.
(a) All meetings shall follow the Roberts Rules of Order format.
(b) If the meeting falls on a nationally recognized holiday, the meeting will be held on the 3rd Thursday of the specified
month.
(c) All reasonable efforts will be made to inform all general members and officers of any meeting changes at least thirty
(30) days before the meeting date.
(d) All major issues affecting MOCSAR or its members will be decided by a majority vote of its members present at a
General Meeting.
(e) A quorum must be present to vote on issues.
(f) Only members may vote.
3.02 Executive/Special meetings. Meetings may be called outside of the regular monthly meeting, by a vote of three (3)
officers. Every reasonable effort will be made to contact and inform all members.
(a) The special meeting may not be for the purposes of election or any binding change of the By-Laws of MOCSAR.
(b) These meetings may be for the impeachment of officers, or removal of members from General Membership.
(c) Written notice must include the purpose for which the meeting was made. This may include social media applications
that are a common communication with all active members.
3.03 Locations. The Board of Directors may designate any public access location, within Montgomery County, as an
approved meeting facility for any General Meeting or any Special Meeting.
(a) The Location of meetings shall be posted on a public access media, along with a written list that will be made
available at every general meeting.
(b) Locations should be within the Montgomery County Area, and in a common public community access center or area
that abides by all State and Federal Handicap Accessible entryways.
(c) Written notice of changes in location will be made at least ten (10) days prior to the meeting date. This may include
social media applications that are a common communication with all active members.
3.04 Voting. During a general meeting, members will be asked to vote on business matters.
(a) Only members that have been voted in after their third meeting may vote during a regular meeting.
(b) Only active members may vote.
(c) A majority vote shall act as a majority vote of the Board of Directors.
3.05 Quorum. Fifteen (15) members must be present, three (3) of which must be board members, in order to conduct
business at a General Meeting, and to transact or vote on any business necessary on behalf of MOCSAR.
ARTICLE IV - BOARD OF DIRECTORS
4.01 General Powers. The affairs of MOCSAR shall be governed by an elected Board of Directors that consists of only
current officers that are decided by a general election or appointment.
(a) Board Positions may be added, or removed, if approved by a majority vote of the General Membership.
(b) Non Members and Non Active Members may NOT be elected or appointed to the Board of Directors positions.
(c) They shall also preside over the General Meeting held as described in Article III, 3.01.
(d) The Board of Directors may create and dissolve committees for special purposes if approved by a majority vote of its
officers.
4.02 Qualifications Members that are elected or appointed to the Board of Directors must meet the following
qualifications.
(a) Must not have any open or pending felonies or misdemeanors.
(b) Must be elected during a general election described in Article VI 6.01, unless appointed under the special
circumstances in Article IV 4.07.
(c) Must be at least 21 Years of Age.
(d) Must be a member in good standing with the local community.
(e) Must be a member for more than one (1) year.
(f) Must have made at least three callouts/events/training in any combination and three general meetings within one
year.
(g) May not have been impeached from another position within two (2) years prior.
(h) Officers must not be married to, or related to each other.
4.03 Meetings. The Board of Directors will meet before the General Meeting of that month, as described in Article III
3.01, in order to discuss subject matter to present at the voting members, or current affairs.
4.04 Special Meetings. Meetings outside of the General Board Meeting may be called by the President, or any two
Directors. At least three (3) board members must be present to make decisions.
(a) The Directors who authorized the special meeting may designate any location, as long as the meeting occurs within
Montgomery County, Texas.
(b) The Special Meeting may not be for the purpose of elections, but may be for appointment of vacancies.
(c) The Special Meeting may be for the impeachment of officers or making binding changes of the By-Laws of
MOCSAR.
(d) Written notice of the meeting must be made 48 hours prior to the meeting.
(i) Written notice can be in the form of a social media application or other form of communication (via text or
email) if it is an appropriate or common way to contact all other board members.
(d) Meetings can be held in the form of Electronic Media, provided that all persons participating in the meeting agree to
do so.
4.05 Quorum. A quorum shall be defined as three (3) Board Members present to transact business at any meeting of the
Board of Directors.
4.06 Manner of Acting. The act of a majority of the Directors present at a meeting at which a quorum is present shall be
the act of the Board of Directors, unless the act of a greater number is required by law or by these bylaws.
4.07 Vacancies. Any vacancy occurring in the Board of Directors, and any directorship to be filled by reason of an increase
in the number of Directors, may be filled by nomination of the Board of Directors.
(a) A member elected to fill a vacancy shall be elected for the unexpired term of his/her predecessor in office.
(b) Vacancies need not be filled unless such a vacancy would result in fewer than three directors remaining on the board.
(c) Nominations for vacancy replacement shall not be final until voted upon by the General Membership.
4.08 Compensation. Directors shall not receive any monetary or in kind salaries for their services in any way
ARTICLE V - OFFICERS
5.01 Officers. The officers of the Organization shall be a President, a Vice President, a Secretary, a Treasurer, a Sergeant at
Arms, and Event Coordinator. The Board of Directors may elect, appoint, or remove such other officers, including one or more
of an already existing position (ie Assistant Secretary, Assistant Treasurer) as it deems necessary. Such officers shall have the
authority and perform the duties prescribed, from time to time, by the Board of Directors. Any two or more offices may not be
held by the same person, under any circumstances.
5.02 Terms. Board Members shall serve a term of no more than two (2) years. After the term is completed an election shall
be held to replace the current serving board members as described in Article V.
(a) Board members may serve consecutive terms.
5.03 Resignation. Any Director may resign by giving a written or verbal notice to the Board thirty (30) days prior, unless
resignation is established due to impeachment.
(a) Voluntary resignation shall be effective at the next called meeting of the Board of Directors, of which meeting the
resigning Director shall receive notice.
(b) Resignation by impeachment shall be effective immediately following a majority vote.
(c) Replacement of the resigned position may be appointed by a majority vote of the Board of Directors, unless the
majority vote was established by the General Members, in which the replacement will be voted upon by the same
authority it was determined by.
(d) A temporary appointment may be made to replace the vacant position for the remainder of the elected time, but is not
necessary unless the vacant position will violate the By Laws or will not allow a quorum to be established.
5.04 Removal. Any Director may be removed with cause by a majority vote of the remaining Directors. Any director
removed with cause may be eligible for nomination for other officer positions within the Board of Directors as long as a
majority vote to do so is established and meets the requirements stated in the Bylaws.
5.05 President. The President shall be the principal executive officer of MOCSAR and shall, in general, supervise all of
the business and affairs of MOCSAR.
(a) Shall preside at all meetings of the Board of Directors.
(b) Shall sign, with the Secretary or any other proper officer of the Organization authorized by the Board of Directors,
any contracts, or other instruments which the Board of Directors has authorized to be executed, except in cases where
the signing and execution thereof shall be expressly delegated by the Board of Directors or by these Bylaws or by
statute to some other officer or agent of MOCSAR; and
(c) In general he or she shall perform all duties as may be prescribed by the Board of Directors from time to time,
including participating in various committee meetings as a member or chairperson thereof.
(d) Shall also be responsible for informing the Board of Directors of possible programs, meetings, and functions of
MOCSAR.
(e) Shall be the main point of contact for callouts or communications with all law enforcement, government, community,
or rescue agencies within or outside of Montgomery County.
5.06 Vice President. In the absence of the President or in the event of his or her inability or refusal to act, the Vice
President, or in the event there be more than one Vice President, the Vice Presidents in order of their election, shall perform the
duties of the President, and when so acting shall have all the powers of and be subject to all the restrictions upon the President.
(a) Any Vice President shall perform such other duties as from time to time may be assigned to him or her by the
President or Board of Directors.
(b) Shall supervise and control the production of any newsletter or public media information that is associated with the
publicity of any public event held by the organization with the assistance of other Board Members as deemed
necessary.
(c) Shall also act as the communication liaison between any coordinator or team leads, and shall be responsible for
keeping the Board of Directors up to date with any changes in training, updates, staffing, or equipment from each of
the team leads.
5.07 Treasurer. The Treasurer shall have charge and custody of and be responsible for all funds and securities of
MOCSAR;
(a) Shall receive and give receipts for moneys due and payable to MOCAR from any source whatsoever, and deposit all
such moneys in the name of the Organization in such banks, trust companies, or other depositories as shall be
selected in accordance with the provisions of these Bylaws.
(b) Shall maintain tax documents and prepare filing documents including Form 990 and 501(c)(3) annual report required
by the State of Texas or the IRS.
(c) Shall ensure the on time payment of any bills or services that require payment .
(d) Shall maintain all liability insurance documents necessary to ensure appropriate coverage required by law.
(e) Shall keep proper books of account and other books showing at all times the amount of funds and other property
belonging to MOCSAR, all of which books shall be open at all times to the inspection of the Board of Directors.
(f) Shall also submit a report of the accounts and financial condition of MOCSAR at each meeting of the Board of
Directors.
(g) In general shall perform all the duties incident to the office of Treasurer and such other duties as from time to time
may be assigned to him or her by the President or by the Board of Directors.
(h) In order to maintain the highest level of internal control, the Treasurer shall not be an authorized signer on checks or
other financial documents of the Organization. The Treasurer for MOCSAR organization may not serve as an
authorized signer on any bank accounts.
5.08 Secretary. The Secretary shall keep the minutes of the meetings of the Board of Directors in one or more books
provided for that purpose;
(a) Shall give all notices in accordance with the provisions of these Bylaws or as required by law.
(b) Shall be custodian of the organization's records.
(c) Shall maintain MOCSAR’s membership roster.
(d) Shall in general, perform all duties incident to the office of Secretary and such other duties as from time to time may
be assigned to him or her by the President or Board of Directors.
(e) Shall update the website with current information as deemed necessary.
(f) Shall maintain records of callouts, trainings, and community events for the purpose of maintaining active
membership and reporting of hours for monthly meetings.
5.09 Sergeant at Arms. The primary responsibility of the Sergeant at Arms is to enforce the conduct standards of the
organization, and should always act in a respectable and responsible manner.
(a) Shall be a role model for the other organization members and must carry out all orders from the Board of Directors
given lawfully in order to support the well being of the Organization.
(b) Shall be responsible for maintaining order in the chamber and other areas used for the conducting business of the
organization.
(c) Shall supervise the entering and exiting of the chamber and other areas.
(d) Shall promptly deliver messages of the Board of Directors to other Board Members.
(e) Shall enforce rules and report violations to the Board of Directors.
(f) Shall inform people when sessions are about to begin.
(g) Shall guard doors at banquets and pass out tickets or media or other items to the general members.
(h) Shall keep hallways clear while sessions are in progress.
(i) Shall be responsible for keeping the meeting on topic and should notify the President, or Vice president in the
absence of such, when the discussion is not moving forward.
(j) Shall maintain a list of assets for the organization and ensure assets are appropriately registered.
(k) Shall be responsible for setting up meeting locations for the year.
5.10 Events Coordinator. Event Coordinator responsibilities include the planning, preparation and execution of events,
with assistance from event sub committees if such is deemed necessary.
(a) Shall establish and maintain relationships with vendors and venues, with all communications written and oral to be
included with the President or Vice President.
(b) Shall plan event details and aspects, including seating, square footage for displays, and volunteer assistance.
(c) Shall keep the Secretary and Vice President updated with all current information.
ARTICLE VI - ELECTION OF OFFICERS
6.01 Election. An election will be held during the General Meeting in the month of November, and will be held every other
year beginning in 1984.
(a) Nominations for officer positions must be submitted by at least one month or thirty (30) days before the election
during the General Meeting.
(b) Nominations must be made in writing submitted to the Secretary. Written notice can be in the form of communication
(via text or email) as long as it is an appropriate way to contact all other board members.
(c) Members may not nominate themselves, and must be present to accept nominations.
(d) In order to be nominated, a member must meet the qualifications described in Article IV, 4.02 of these Bylaws.
6.02 Transfer. Elected officers will take office on December 1st of the election year. Throughout the month of December
and the following January, elected officers and officers that are preceded, will work together to ensure a smooth and
constructive transfer of responsibilities.
6.03 Vacancy. If a vacancy occurs for any reason, the remaining officers can appoint a replacement to serve until the next
regular election.
(a) A vacancy is not required to be filled if the Board of Directors deems it not necessary to do so. The Board of
Directors can remove or add offices as needed to maintain a well organized administration.
6.04 Succession. Any officer may succeed himself if so elected, unless an impeachment occurs, in which case the officer
impeached shall not be able to be elected, or appointed, into any officer position for no less than two (2) years.
6.05 Voting. A minimum of three General Membership Meetings or callouts must be attended within a calendar year from
the first day of October to the last day in September prior to the election in order to vote in a general election.
ARTICLE VII - IMPEACHMENT OF OFFICERS
7.01 Acts Any Officer or Board Member may be impeached with cause if the majority of the Board of Directors decides
that the actions of the suspected Officer or Board Member has violated the Bylaws, or has brought an image upon the
Organization that damages the public opinion, or violated a law or laws of the Municipal, State, or Federal Law.
(a) All impeachment decisions must be brought before a disciplinary board consisting of at least three (3) Board
Members and two general members before a final decision can be made.
(b) Replacement nomination of the officer impeached shall be made by a majority decision of the Board of Directors as described in Article I, 1.04, except that the impeached officer may not be appointed as replacement.
(c) The recommendation for vacancy replacement shall be voted upon by the General Membership during a general
meeting.
7.02 Quorum. Any officer may be impeached by a quorum vote as described in Article IV,4.05.
7.03 Tie Vote. If a majority vote cannot be established, the nominations will be brought before the voting members during
a General Meeting. The majority vote of the General Membership shall act as a majority vote of the Board of Directors.
(a) If a majority vote cannot be established during a General Membership Vote, then the President of the Board of
Directors may arbitrate the decision.
(b) The decision of the President during arbitration shall act as a majority vote of the Board of Directors.
7.04 Removal. Any Officer or Board Member that is impeached shall resign from office as soon as the impeachment
agreement is reached. The person:
(a) Shall not be nominated for any Board of Director position for a minimum of 2 years.
(b) Shall be placed on a probation period as a general member for no less than ninety (90) days. During which he or she
will be under observation for conduct or Bylaw violations.
(c) May be removed from membership completely if a decision is made, by a separate majority vote, by the Board of
Directors; unless the original impeachment was brought before the General Membership, then a majority vote for the
removal may be established by the General Membership, and shall act as a majority vote of the Board of Directors.
(d) An impeached officer shall not be immediately removed from membership, if the impeachment decision is
established by an arbitrary decision of the President of the Board of Directors, during an impeachment vote session.
ARTICLE VIII - FUNDS
8.01 Minimum Balance. A minimum balance of $3,000.00 will be maintained in company funds for the sole purpose of
supplying the needs of MOCSAR during official call out operations. If funds are depleted during a callout the organization will
immediately put funds back into the account within 90 days.
8.02 Minor Purchases. Spending of funds up to $500.00 by the President and Vice President will not require prior
authorization by any other member of the Board or General membership.
(a) A majority of the Board has the authority to spend up to $500 without prior membership approval.
(b) All purchases shall be reported to the Treasurer and must be listed on the Treasurer's Report.
8.03 Major Purchase. Single expenditures $500.01 to $1,000.00 must be approved by a majority vote of the Board of
Directors as described in Article IV, 4.03.

8.04 Discrepancy. If the Board of Directors cannot agree on a purchase of any amount, the motion will be brought to the
General Members as described in Article I, 1.04. If a majority vote still cannot be established, then the President of the Board of
Directors, shall arbitrate the decision, and the arbitrary ruling shall act as a majority vote of the Board of Directors.
8.05 Checks. A dual signature check system will be in effect at all times. If one signer is removed from office and a
vacancy occurs, then no purchases can be made until a signer is appointed by a majority vote of the Board of Directors.
8.06 Debit Card. The President and Vice President only will have authority to use the MOCSAR debit card for purchases
under $500.00.
(a) All purchases must be reported to the Treasurer and must be reported on the Treasurer’s Report.
8.07 Donations. All monetary and in kind donations must be documented monthly, and a financial report must be made
readily available to the entire organization upon request. Donations must meet the standards set by 170(c)(2) of the Internal
Revenue Code and Regulations.
ARTICLE IX - COMMUNITY
9.01 Relations. The MOCSAR will strive for a harmonious relationship with Montgomery County Sheriff's Department,
County Commissioners and all other County and State Agencies, including Fire and Rescue organizations within or outside
Montgomery County, Federal Organizations such the Office of Emergency Management etc., along with a relationship with the
local community that holds to the highest standards of good faith.
9.02 Citizens. The MOCSAR recognizes the valuable input and close working relationship and the benefit for the citizens
of Montgomery and other counties. The main function of the Organization is to serve the citizens of the community that are in
need of aid.
9.03 Media. Any public correspondence, comments, presentations, or contact with any news media must be approved by
the President or Vice President of MOCSAR prior to. No member may talk to or speak for MOCSAR, unless approved by the
Board of Directors prior to thereof. Any member speaking on behalf of MOCSAR without permission will be subject to
disciplinary action and will also be subject to a probationary period as defined in Article II,2.04 and/or removal from the
MOCSAR Organization.
ARTICLE X - AMENDMENTS
10.01 Amendments Changes or additions to the Bylaws can be made by a majority vote of the General Membership
during a regular meeting as described in Article I, 1.04(a).
10.02 Contests Any changes or additions to amendments can be contested by any member during the General Meeting.
(a) All contests made by general members must be investigated by the Board of Directors.
(b) All contestations brought forth during General Meetings shall need a: Motion to Vote, and a two (2) Seconds in order
to be brought to a vote.
10.03 Effect Changes and additions to the Bylaws or Organization shall not take effect until thirty (30) days or the day
after the following General Meeting established in Article III,3.01, pending general member contests that are made known.
(a) Contests must be within thirty (30) days or a calendar month, beginning the day the change or addition was voted on
and the General Meeting of the following month.
(b) If the changes or additions to the Bylaws that are made during General Meetings, and the next General Meeting
would not allow thirty (30) days to pass, then the change or addition will not go into effect until the thirty (30) days
has passed.
(c) A change or amendment can go into effect immediately if voted on by the General Membership and a majority vote
is established.
ARTICLE XI - CALLOUTS
11.01 Deployment. In the event of a callout, this organization may be deployed, to any location within or outside
Montgomery County, to use resources necessary to perform its main function, Search, Find, Rescue, and work with Law
Enforcement Agencies, or other Rescue Agencies, to help in various situations such as lost or missing persons or items, hiking
accidents, high water and wilderness rescue. It is the mission of search teams to identify and document clues in order to track
and successfully locate missing or overdue persons involved in any of the situations listed.
11.02 Incident Command. During a callout the MOCSAR Team shall use the Incident Command System (ICS) as defined
in the FEMA ICS 100 Course description, and will use such positions as Incident Commander, Team Lead, Command Staff and
utilize such structure to maintain Incident Command, Operations, Planning, Logistics, Finance/Administration.
(a) The President or acting Vice President may appoint members to act as standing Incident Command if no Incident
Commander is present on scene for the purposes of gathering information or location details.
11.03 Liability. Any personal possessions, or equipment, of a member that are used, or authorized for use by that member,
on or during any call outs, or function, of MOCSAR is at the sole risk of that member. MOCSAR cannot be held liable for any
damages to personal equipment due to misuse or negligence.
11.04 Firearms. No fire-arms of any kind are allowed on a callout, meeting, or event by any members of MOCSAR.
Members that are in possession of a firearm at any MOCSAR event, meeting or callout will be subject to any laws or statutes of
the State of Texas, disciplinary action from MOCSAR, and will be removed from the area.
(a) Any members found in possession of a firearm will obey any and all law enforcement, or MOCSAR officer
commands to be relieved of their weapon and/or removal from the location or area.
11.05 Alcohol and Drug Abuse. No alcoholic beverages or illegal drugs will be permitted at any time during a callout, or
at any MOCSAR sponsored functions including, but not limited to: General Meetings, Fundraisers, Events, Sponsorship
Meetings.
(a) Any members found intoxicated, or under the influence, or in possession of drugs, narcotics or alcohol, during such
events, will not be allowed to respond to Callouts, and will be subject to discipline by MOCSAR, and/or arrest if
circumstances are warranted or determined by the appropriate law enforcement agency
